Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Syvon Go mobile application and the Syvon.ai platform (the "Service"), provided by Syvon.ai ("Syvon.ai," "we," "us," or "our"), a company based in Panama. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Service Description

Syvon.ai provides an AI-powered platform for brand content production. Syvon Go is the mobile companion that lets you prompt your brand autopilot to generate, render, curate, and publish on-brand content from your device.

2. User Accounts

To use the Service you must create an account. You agree to provide accurate information and to keep it current. You are responsible for safeguarding access to your account and for all activity under it. Notify us immediately of any unauthorized use. You may delete your account at any time from within the app.

3. License and Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business purposes. You may not sublicense, resell, or transfer your rights to any third party.

3.1. Acceptable Use

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms, including to damage or impair the Service, gain unauthorized access, introduce malicious code, or reverse engineer the Service.

4. Fees and Payment

Where the Service is offered on a paid basis, fees and billing terms are presented at the point of purchase. All fees are non-refundable except as expressly provided or as required by applicable law or the relevant app store's policies.

5. Intellectual Property

We and our licensors own all right, title, and interest in the Service and its associated intellectual property. You are not granted any rights to our intellectual property except the limited license described here.

5.1. User Content

You retain ownership of the data and content you upload or provide ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify your User Content solely to provide the Service to you. We do not use your User Content to train AI models or share it with third parties for purposes other than delivering the Service.

5.2. AI-Generated Content

The Service may generate output based on your User Content. AI-Generated Content may be inaccurate or contain errors; you agree to review and validate it before relying on it. We disclaim liability for inaccuracies in AI-Generated Content.

6. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

9. Governing Law

These Terms are governed by the laws of the Republic of Panama, without regard to its conflict of law provisions. Any dispute shall be finally settled by arbitration in Panama City, Panama.

10. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
